YOU SHOULD CAREFULLY READ THE FOLLOWING LICENSE TERMS AND CONDITIONS BEFORE INSTALLING THE SOFTWARE.
INSTALLING THE SOFTWARE INDICATES YOUR ACCEPTANCE OFTHESE TERM AND CONDITIONS.

If you do not accept these term and conditions, you must not install the software and return the diskette and all the other components of the product.

License:
Upon your acceptance of this License Agreement, you are granted by the Licensor a non-exclusive site license to use this software including the documentation (the "software"), subject to the terms and condition of this License Agreement.
Title to and ownership of the software remains with the Licensor and its licensors.

You may:
use the software on any compatible computer in the same purchasing institution.
You may not:
modify, merge, translate, decompile, disassemble, create derivative works, or otherwise alter or reverse the software.
grant sublicenses, leases, or other right to the software to other.
use, copy, or transfer the software, in whole or in part, except as expressly provided for in this license.

Trem:
Without prejudice to any other rights, Phantom II LLC. may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement.
In such event, you must destroy the Software and all its component parts.

Limited Warranty:
Licensor will replace any diskette found to be defective unless cause by your mishandling or improper use.
IN ALL OTHER RESPECTS THE SOFTWARE AND ALL UPDATES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED, TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
THE ENTIRE RISK AS TO SUITABILITY, QUALITY, RESULTS AND PERFORMANCE OF THE SOFTWARE AND UPDATES IS WITH YOU.
SHOULD THE SOFTWARE OR UPDATES PROVE DEFECTIVE, YOU (AND NOT LICENSOR OR ITS LICENSORS) ASSUME ALL LIABILITY AND EXPENSE INCURRED AS A RESULT THEREOF.
Licensor and its licensers do not warrant that the functions contained in the software or updates will meet your requirements or that the operation of the software and updates will be uninterrupted or error free.

Limitation of Remedied:
IN NO EVENT WILL LICENSOR OR ITS LICENSORS SE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES, SUCH AS LOST PROFITS, LOST SAVING OR OTHER DIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGE ARISING OUT OF THE USE OR INABILITY TO USE THIS SOFTWARE OR UPDATES EVEN IF ADVISED OF POSSIBILITY OF SUCH DAMAGE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF DIRECT, INCIDENTIAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

You may not sublicense, assign or transfer the license of the Software. Any attempt to sublicense, assign or transfer any
of your rights, duties, or obligations hereunder, is null and void and not merely violable.
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE, THAT THIS IS THE COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN YOURSELF AND PHANTOM II LLC., WHICH SUPERSEDES ANY PROPOSAL OR REPRESENTATIONS, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN PHANTOM II LLC. AND YOURSELF RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
THIS IS A LEGAL AGREEMENT BETWEEN YOU, THE CUSTOMER, AND PHANTOM II LLC. THE SOFTWARE IS PROTECTED BY COPYRIGHT LAWS AND INTERNATIONAL COPYRIGHT TREATIES, AS WELL AS OTHER INTELLECTUAL PROPERTY LAWS AND TREATIES. THE SOFTWARE IS LICENSED, NOT SOLD.
